Terms and Conditions of Service
Definitions
"Badge Wave", "we", "us": Refers to Badge Wave, which is operated as part of Soabar Ltd, registered company number 06546634.
"Customer", "you": Refers to the person or entity placing an order.
"Goods": Refers to the custom-printed event badges and associated services.
Orders and Artwork Approval
- Contract Formation: A binding contract is formed once we have accepted your order and you have provided approval of the final artwork proof.
- Responsibility for Accuracy: By approving the digital proof, you confirm that all details (spelling, logos, design, colours) are correct. Badge Wave is not liable for errors present in the approved artwork. Any reprints required due to customer error after approval will be at the customer's expense.
- Customisation: All items are manufactured to your specific requirements. By placing an order, you acknowledge that these goods are "made to measure" or "personalised" under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Cancellations & Refunds
Right to Cancel: Because our goods are bespoke/personalised, the statutory 14-day "cooling-off" period for distance selling does not apply.
- Pre-Production Cancellation: You may request to cancel your order at any time before artwork approval. We reserve the right to charge a fee for any design work already completed.
- Post-Approval Cancellation: Once artwork is approved and production begins, orders cannot be cancelled or refunded.
Faulty Goods: If goods are damaged, faulty, or do not match the approved artwork, you must notify us in writing within 48 hours of receipt and provide photographic evidence. If confirmed as a production error, we will provide a replacement or, where a replacement is not possible, a refund.
Shipping & Delivery
- Production Times: Standard service is dispatched within 7 business days of artwork approval. Express service (surcharge £80.00) is dispatched within 3 business days of approval.
- Delivery Liability: We use reputable third-party carriers (Parcelrite/APC for UK; DHL for international). While we take care in packaging, Badge Wave is not liable for delays caused by the carrier.
- International Customs: For international orders, the customer is responsible for all customs duties, import taxes, and local fees.
Intellectual Property
- The customer warrants that they have the legal right/permission to use all logos, branding, and imagery provided to Badge Wave for printing. The customer agrees to indemnify Badge Wave against any claims arising from copyright or trademark infringement regarding the files supplied.
Liability
- To the fullest extent permitted by law, Badge Wave’s total liability for any claim arising from an order shall not exceed the total price paid by the customer for that specific order.
